This Photography Property Rental Agreement ("Agreement") is entered into by and between King's Bounty Farm ("Property Owner") and the individual or business making the reservation ("Photographer"), collectively referred to as the "Parties."
This Agreement applies to each appointment included in the Photographer's order. By entering their full name, checking the agreement box, and submitting the required payment, the Photographer acknowledges that they have read, understood, and agreed to the following terms.
For purposes of this Agreement, "Client" means any person accompanying or being photographed by the Photographer, including clients, guests, family members, children, assistants, or other session participants. The Photographer is responsible for ensuring that all Clients comply with this Agreement and with instructions provided by the Property Owner.
Under Idaho law, there are risks associated with agritourism, which could lead to injury or death. You are assuming these risks. Section 6-3004, Idaho Code.
1. Booking & Payment
A 50% non-refundable deposit is required at the time of booking to reserve each appointment.
The remaining balance for each appointment is due no later than 24 hours before that appointment. When an order contains appointments on multiple dates or at multiple times, the payment deadline for each appointment is determined separately.
Failure to pay an appointment's remaining balance by its deadline may result in cancellation of that appointment, forfeiture of its deposit, and release of the reserved time for another photographer. Cancellation of one appointment for nonpayment does not automatically cancel other appointments included in the same order.
Appointments booked within 24 hours of their scheduled start time, when such bookings are made available by the Property Owner, must be paid in full at the time of booking.
2. Cancellation & Rescheduling
More than 24 hours before an appointment, the Photographer may reschedule the appointment without an additional rescheduling fee, subject to availability.
If an appointment that has been paid in full is cancelled more than 24 hours before its scheduled start time, 50% of the total rental fee will be refunded. If only the required deposit has been paid, the deposit is non-refundable.
Cancellations made less than 24 hours before the scheduled appointment are not eligible for a refund. Rescheduling is not permitted less than 24 hours before the scheduled appointment. Amounts already paid for an appointment cancelled within that period are forfeited.
No-shows are not eligible for a refund or rescheduling.
Customer self-service cancellation and rescheduling become unavailable 24 hours before the scheduled appointment.
Any exception made by the Property Owner to these policies is discretionary, applies only to the specific circumstance for which it is granted, and does not modify this Agreement or establish a right to similar exceptions in the future.
3. Weather
In the event of severe or unsafe weather, the Property Owner or Photographer may determine that an appointment cannot safely proceed. When an appointment is cancelled because of severe or unsafe weather, the Photographer may choose to reschedule without penalty or receive a refund for amounts paid for the affected appointment.
Mild, inconvenient, or undesirable weather does not automatically qualify an appointment for weather cancellation or refund. The Property Owner retains discretion regarding whether conditions on the property are unsafe for photography activities.
4. Appointment Times & Property Access
The Photographer's use of the property is limited to the date and time reserved. The Photographer and all Clients must conclude photography activities, collect their belongings and equipment, and vacate the photography area by the end of the reserved appointment time.
Back-to-back appointments may be scheduled. The Photographer may not remain in or continue using the photography area beyond the reserved time in a manner that interferes with another reservation.
Photographers, Clients, and guests must follow all posted or communicated parking and property-access instructions. Unless otherwise directed by the Property Owner, vehicles must be parked in the designated area and may not use or obstruct the Property Owner's private residential driveway or other restricted areas.
Access to the property is limited to designated photography and access areas. Private residential areas, buildings, fields, structures, equipment, or other portions of the property not designated for photography are off limits unless the Property Owner expressly authorizes access.
5. Property Use & Media Attribution
The property, props, vintage red truck, and designated photography areas may be used for photography purposes during the Photographer's reserved appointment time.
Photographers are encouraged to credit or tag @KingsBountyFarm on Facebook or Instagram when publicly sharing photographs created on the property.
King's Bounty Farm may repost publicly shared content in which King's Bounty Farm has been tagged, with appropriate photographer credit.
6. Custom Setups
Custom photography setups are welcome with advance notice and approval.
Setups involving additional decorations, furniture, equipment, structures, materials, alterations, or unusual use of the property may require prior approval and may be subject to additional fees.
Nothing may be permanently attached to, altered, painted, nailed, screwed, stapled, or otherwise affixed to the property, structures, vehicles, or props without express permission from the Property Owner.
All Photographer-provided setup materials must be removed at the conclusion of the reserved appointment unless other arrangements have been approved in advance.
7. Pets
Pets are welcome unless otherwise stated for a particular area or setup.
The Photographer is responsible for supervising pets brought onto the property and for ensuring that they do not damage or soil the property, landscaping, props, vehicles, structures, or photography areas.
Photographers should bring appropriate supplies, including a towel when conditions warrant, and must promptly clean up and remove all pet waste.
The Photographer is responsible for damage or excessive cleaning caused by pets belonging to the Photographer or the Photographer's Clients or guests.
8. Conduct, Supervision & Cleanliness
The Photographer is responsible for the conduct and supervision of all Clients, guests, children, assistants, and pets accompanying the Photographer.
Children must be appropriately supervised while on the property.
The Photographer and Clients must respect the property, landscaping, props, structures, equipment, vehicles, animals, and designated photography areas and must follow reasonable safety or property-use instructions provided by the Property Owner.
Personal belongings, photography equipment, decorations, setup materials, and trash must be removed by the end of the reserved appointment.
Damage, misuse of the property, excessive cleaning, failure to follow property rules, or failure to supervise Clients or guests may result in cleaning or damage charges, termination of the appointment, or loss of future rental privileges.
9. Assumption of Risk
The Photographer acknowledges that King's Bounty Farm is a rural property and that use of a farm or rural property may involve inherent risks and naturally occurring conditions that cannot be completely eliminated.
Such risks may include, as applicable, uneven or irregular ground, surface and subsurface conditions, mud, gravel, vegetation, weather conditions, water, insects, wildlife or domestic animals, and ordinary conditions associated with farm or rural structures, equipment, landscaping, and outdoor areas.
The Photographer agrees to exercise reasonable caution and to ensure that Clients and guests follow posted notices and reasonable instructions provided by the Property Owner.
To the fullest extent permitted by applicable law, the Photographer knowingly assumes the inherent risks associated with entering and using the property and participating in photography activities there.
Nothing in this Agreement is intended to waive or limit liability that cannot lawfully be waived or limited.
10. Personal Property
The Photographer and Clients are responsible for their own cameras, photography equipment, vehicles, clothing, props, personal belongings, and other property brought onto the premises.
To the fullest extent permitted by law, King's Bounty Farm is not responsible for loss, theft, or damage to personal property resulting from inherent risks of the property or the acts or omissions of the Photographer, Clients, guests, or other participants.
11. Damage & Cleaning
The Photographer is financially responsible for damage to the property, landscaping, props, vehicles, structures, or equipment caused by the Photographer or the Photographer's Clients, guests, children, assistants, or pets, beyond ordinary wear associated with permitted use.
The Photographer may also be responsible for reasonable costs resulting from excessive cleaning or restoration made necessary by such use.
12. Electronic Acceptance
This Agreement may be accepted electronically.
By entering their full name, checking the agreement box, and submitting the required payment, the Photographer confirms that they have read, understood, and agree to this Agreement and acknowledges that their electronic acceptance is intended to constitute their agreement to these terms.
The accepted version of this Agreement, together with the Photographer's entered name and the date and time of acceptance, may be retained electronically by King's Bounty Farm as part of the booking record.
